A council faces prosecution following the death of a schoolboy during a caving trip.

Tadcaster Grammar School student Joe Lister, 14, died three years ago in Manchester Hole Cave in Nidderdale, in the Yorkshire Dales.

Now, the Health and Safety Executive is to bring a case against North Yorkshire County Council, which runs the Bewerley Park Outdoor Education Centre, which ran the trip during which the schoolboy died.

The prosecution will be brought under the Health and Safety at Work Act 1974.

The HSE alleges that the council failed to ensure the safety of Tadcaster Grammar School pupils, including Joe Lister. It also alleges that it failed to ensure the safety of one of its employees, a teacher from the school, who accompanied the party underground.

The case will be heard at Harrogate Magistrates Court on 27 February next year.

Coroner Geoff Fell recorded a narrative verdict on Joe’s death at an inquest held in November last year.
